Astronomers Catch Video of 'Near-Miss' Asteroid

A small asteroid called 2012 KT₄₂ came within three Earth radii of striking the planet on 29 May, but slipped past. The event was the sixth-closest encounter of any recorded asteroid.

In a video posted online on 19 June by researchers using NASA's Infrared Telescope Facility (IRTF) in Hawaii, the bright asteroid appears fixed, while background stars zip past (in fact, the asteroid is speeding along at 17 kilometres per second). ?You get the view of riding along with it,? says Richard Binzel, a planetary scientist at the Massachusetts Institute of Technology in Cambridge, who led the observations. At its closest, the asteroid was around 19,000 kilometres from Earth ? a distance between the orbit of the International Space Station (about 1 Earth radius) and that of a geosynchronous satellite (about 6 Earth radii).

Hours after the object was discovered by a small telescope on Mount Lemmon near Tucson, Arizona, Binzel was able to obtain a few hours of time on the IRTF. The resulting in-depth study was innovative for such a small object.

By determining 2012 KT₄₂'s composition and reflectivity, Binzel was able to use the brightness of the asteroid to estimate its size: about 7 metres across. He says several objects this size cross Earth?s path every year.

2012 KT₄₂ is now continuing on its 1.5-year elliptical orbit of the Sun. Even if it had struck Earth, Binzel says, it probably would have burned up in the atmosphere. Binzel wants to discover an object that is not big enough to present a hazard to Earth, but is large enough to be spotted in space and later found on the ground as a meteorite, as was the asteroid 2008 TC₃, which came to Earth in Sudan in October 2008 (see the 'The rock that fell to Earth'). ?I want them to be just the right size to deliver some fresh samples,? he says.

Research shows new prognosis tool for deadly brain cancer

A diagnosis of glioblastoma multiforme (GBM) is generally a death sentence, but new research from the University of Wisconsin-Madison lab of Dr. John Kuo shows that at least one subtype is associated with a longer life expectancy. This discovery could help with better patient prognoses and lead to targeted drug treatments for GBM subtypes.

People diagnosed with GBM live on average less than 15 months after diagnosis, even after undergoing aggressive surgery, radiation and chemotherapy. But not all GBM cancers are the same, and Kuo's study outlines a new method for sub-typing GBM tumor lines by the proteins they express.

The paper, published early online by the journal Clinical Cancer Research, shows that people who have a subtype of GBM that expresses a particular protein, known for short as CNP, may have a less aggressive subtype of cancer. The survival rate for those with the subtype is sometimes measured in years, not months.

The group isolated tumor lines from five human patients and grew them in the lab, and then looked for biomarkers specific to each line. They later transplanted the tissue into the brains of mice with compromised immune systems.

The researchers also looked for the CNP subtype in samples from 115 human patients and then looked at data on survival rates for those patients. They found that some patients with the protein lived much longer, as long as 10 years after diagnosis.

"We found that this protein was correlated with a less invasive type of cancer in mice, and when we looked at samples of human tumors, remarkably, we also found that the less invasive tumors expressed the CNP protein,'' says Kuo, assistant professor of neurological surgery and human oncology at UW School of Medicine and Public Health.

Kuo says the sub-typing could lead to more accurate prognosis for patients with a GBM diagnosis. Currently, most sub-typing of GBM tumors is based on mRNA, which can be difficult to do. But Kuo says that most hospitals can run assays for proteins, making the test simpler and easier.

In addition, says Michael Zorniak, Kuo's graduate student and lead author on the paper, the new way of typing tumors could lead to designer chemotherapy for GBM.

"As we understand how tumors are differentiated, we can start devising personalized therapies that are targeted to the specific sub-type of cancer,'' he says. "This can help us gain leverage against this difficult cancer."

For example, researchers could create monoclonal antibodies that bind only to the CNP type of cancer, in the way that some subtypes of breast cancer are currently targeted.

Following a hypocaloric diet increases the chance of achieving minimal disease activity

Berlin, Germany, June 8 2012: According to a study presented today at EULAR 2012, the Annual Congress of the European League Against Rheumatism, patients with psoriatic arthritis (PsA) who are starting anti-tumour necrosis factor (anti-TNF) treatment and adhere to a hypocaloric diet have a significantly greater chance of achieving minimal disease activity (MDA, an important measure of disease activity) at six months compared to those on a standard diet.

The results of an Italian study of 138 obese PsA patients demonstrated that those who achieved a ?10% weight loss following a calorie restricted diet, were more likely to achieve MDA, compared to patients on a standard diet (p=0.001). These patients also had significantly higher changes in erythrocyte sedimentation rate (ESR, a test that indirectly measures the amount of inflammation in the body), and c-reactive protein (CRP, a marker of systemic inflammation, a recently identified predictor of structural damage progression) compared to patients on a standard diet.

"A study presented at the 2009 meeting of the Society for Investigative Dermatology, alerted us to the fact that patients with psoriatic arthritis have an increased prevalence of obesity, however our study has gone beyond that, assessing whether diet is able to improve the achievement of minimal disease activity in obese patients treated with anti-TNFs" said Dr. Dario Di Minno from the University of Naples Federico II, Italy and lead author of the study. "The results of our study suggest that obese patients with psoriatic arthritis who stick to a hypocaloric diet have a greater chance of achieving treatment goals."

The study demonstrated that a hypocaloric diet is a predictor of MDA achievement (hazard ratio [HR]: 4.79; p=0.002) after six months of treatment with anti-TNFs in patients as compared to those on a standard diet. Of the 138 obese subjects with PsA, 69 received a hypocaloric diet and 69 a self-managed diet. At baseline and at six months follow-up, patients underwent a complete clinical rheumatologic and laboratory evaluation.

In a separate PsA study by the same authors, 135 obese and 135 matched normal-weighted patients (controls) with active disease starting treatment with anti-TNFs were followed for 24 months to evaluate whether the presence of obesity impacts the achievement of MDA. Of the 270 subjects, 36.3% achieved MDA and the prevalence of obesity was higher in those not achieving MDA than in those achieving it (64.0% versus 25.5%, p

Two killers against one — not exactly the fairest of odds, no, but it certainly sets the stage for one of the coolest fights we've seen on screen all year long.

It's only fitting, then, that "The Hunger Games" took home Best Fight at the 2012 MTV Movie Awards Sunday night (June 3), gifting both Jennifer Lawrence and Josh Hutcherson with their second Golden Popcorn statuettes of the night, and bad boy Alexander Ludwig with his first.

The award was presented by "Prometheus" co-stars Charlize Theron and Michael Fassbender, who thought his Irish heritage and famous and much-discussed manliness meant he could handle the duties himself.

"I was thinking since I'm Irish, I would just handle this one," Fassbender rationalized. "Yeah, you know, fighting Irish and all that. And considering you're a girl and all that."

Unfortunately for Fassbender, Theron wasn't having it, and decided to show him exactly how tough even the most glamorous girl can be. The poor guy didn't get past "And the nominees are" before she'd knocked him to the floor with just a handful of swift (mock) blows. For his part, Fassbender played the part of the victim well, writhing on the floor in faux pain before working his way back on his feet.

Just as the "Twilight" films have dominated the Best Kiss category over the past several Movie Awards shows, so too is "Hunger Games" poised to own the Best Fight arena in the years to come. After all, these movies are about unwitting contestants battling to the death — every film from "Catching Fire" to the two-part "Mockingjay" will feature scenes of brutal violence, with lead actors Lawrence and Hutcherson often on the front lines of the action.

"Wow, this is really cool," Hutcherson, who also scored the prize for Best Male Performance, told the audience. "I've always loved doing stunt work [and] producers have always hated me for that because they've never want me to do it."

Hutcherson and Ludwig's fellow Best Fight winner, Best Female Performance winner Jennifer Lawrence, was unable to make it to the awards because she is in Prague filming "Serena."

"We were filming 'til like six in the morning that night so it was an amazing experience," Ludwig added before thanking "Hunger Games" fans for all their support.

Of course, you won't see Ludwig in any future "Hunger Games" fights — his character, the cruel and cunning Cato, was the ill-fated loser of the Movie Awards-winning fight. But District 2 supporters, never fear: You'll get to see the man who plays Cato again very soon when he makes an unlikely "Twilight" crossover with Taylor Lautner in next year's "Grown Ups 2." Who knows? Perhaps that mash-up could be eligible for Best Fight in a couple of years!

Annan frustrated over Syria, Russia gives no ground

BEIRUT (Reuters) - International envoy Kofi Annan said on Friday he was "frustrated and impatient" a week after a massacre in Syria of 108 people shocked the world, but Russia said his peace plan was still the best hope for Syria.

Speaking after separate talks with German Chancellor Angela Merkel and French President Francois Hollande, President Vladimir Putin urged countries to continue to back Annan's peace initiative as the best way to avoid full civil war.

"Mr. Annan is a very experienced and respectable person and we must do everything for his mission to succeed. I think it is counterproductive to announce his mission as a failure in advance," Putin told a news conference in Paris.

"Sanctions don't always work. The main thing we need to do is to prevent the situation from developing under the worst scenario and not let a civil war take place."

Damascus says it wants Annan's plan to succeed so the crisis can be resolved through political talks.

But Syrian rebels, who agreed to Annan's April 12 truce plan, have urged him to declare the plan dead, freeing them from a commitment that both sides have repeatedly violated.

The plan calls for the government to pull heavy weapons back from towns and cities, after which both sides are to end violence and begin a dialogue, but it has stalled at the first hurdle.

Although refusing to declare the ceasefire a failure, Annan welcomed any further steps from the U.N. Security Council.

"If there are other options on the table, I will say 'bravo' and support them," Annan told reporters after talks in Beirut with Lebanese Prime Minister Najib Mikati.

"SANCTIONS ESSENTIAL"

Hollande said Syrian President Bashar al-Assad's government had disqualified itself from ruling Syria.

"No solution to this crisis is possible without the departure of Bashar al-Assad," he said, standing next to Putin. "I believe that more sanctions are an essential part of a political solution."

Outrage at last Friday's mass killings in Houla, documented by U.N. observers, prompted a host of Western countries to expel Syria's senior diplomats, and to press Russia and China to drop their vetoes and allow tougher U.N. Security Council action.

China and Russia back Annan's plan, the only broadly accepted initiative to halt the bloodletting in Syria, and reject any intervention, U.N.-backed sanctions, or proposal .

The 193-nation U.N. General Assembly is planning to meet next week to discuss the crisis in Syria and the massacre in Houla. Ban, Annan and U.N. human rights chief Navi Pillay are likely to address the assembly on Thursday, U.N. diplomats said.

Annan will also speak to the 15-nation U.N. Security Council that day about the lack of progress implementing his peace plan.

Arab League Secretary-General Nabil Elaraby urged the Council to "move quickly to end all acts of violence taking place in Syria, and to take the necessary measures to protect Syrian civilians", according to a letter leaked to media.

That proposal is similar to language the Council used last year to authorize military intervention in Libya, which Russia did not veto but has criticized ever since. Russia has vowed to prevent Syria from becoming another Libya, where it says NATO airstrikes directly supported rebels and led to "regime change".

RIGHTS COUNCIL

Russia, China and Cuba all voted against a resolution passed by the 47-member Human Rights Council in Geneva on Friday condemning Syria for the massacre in the Houla region and calling for a U.N. investigation to gather evidence for possible criminal prosecution.

Russia's Foreign Ministry backed the Syrian government's assertion that the massacre was the work of anti-government forces intent on undermining peace efforts.

But in Paris, Putin took a different line.

He appeared to accept that Syrian government forces had at least played a part in killing civilians, but said the rebels were guilty of similar acts.

"How many peaceful civilians were killed by the opposite side? Did you count? The count goes into the hundreds there too. Our goal is make peace between the sides of the conflict."

"We are not for Assad, not for his opposition," he said. "We want to reach a situation where violence ends and a large-scale civil war is averted."

U.S. Secretary of State Hillary Clinton will meet Russian Foreign Minister Sergei Lavrov this weekend, Donahoe said.

Clinton said Washington was ready to cooperate with Moscow if it was ready to work on a political transition in Syria.

Putin denied that Russia, which supplies Syria with weapons, was providing the government with the means to crush rebels, brushing off Clinton's comment that its latest shipment to Syria was "reprehensible".

The Kremlin does not want to lose its firmest foothold in the Middle East - a client for billions of dollars' worth of weapons and the host of Russia's only warm-water naval port outside the former Soviet Union.

Putin told reporters in Berlin that Moscow had a "good, long-standing relationship with Syria".

"As for supplying weapons, Russia does not provide weapons that could be used in a civil conflict," he said.

GUNFIRE AND CLASHES

The Syrian Observatory for Human Rights, a British-based monitoring group, said at least 20 people had been killed in clashes in Syria on Friday. It said hundreds of thousands of civilians had attended opposition protests around the country.

A day before, a dozen workers were killed near the western town of al-Qusair when gunmen loyal to Assad ordered them off a bus and shot them, activists said. Syrian media blamed "terrorists".

Video released by activists showed the corpses of 12 men, two of them with the tops of their heads shot away, laid out on the ground near the town of al-Qusair, which like Houla is about 20 km from the city of Homs, a hotbed of opposition to Assad.

Hamza Al-Buweida, a local opposition activist, said a survivor had told him the dead men had been returning from work at a fertilizer company in al-Buweida al-Sharqiya.

"They stopped, as usual, at a Syrian army checkpoint. But about 300 meters after the checkpoint a yellow car with four armed shabbiha (pro-Assad militia) stopped their car," he told Reuters over Skype.

"They took money off the men and then killed them one by one with gunshots to the head. More than 300 bullets were found in the bodies."

It was impossible to verify Buweida's account. Syria has restricted journalists' access since the start of the uprising against Assad 15 months ago.

Activists say 50 to 100 people have died each day this week, including civilians, soldiers and anti-Assad rebels.

U.N. High Commissioner for Human Rights Navi Pillay said those who carried out the slaughter in Houla could be prosecuted for crimes against humanity.

Egypt's Mubarak sentenced to life in prison

CAIRO (AP) ? Hosni Mubarak was sentenced to life in prison Saturday for failing to stop the killing of protesters during the uprising that ousted him, offering his opponents a measure of justice. But he and his two sons were acquitted of corruption in a verdict that did not satisfy public demands for accountability after what the chief judge called 30 years of "darkness" under the old regime.

The mixed ruling set off street protests and by nightfall, a large crowd of up to 10,000 was back in Cairo's Tahrir Square, the birthplace of the uprising, to vent anger over the acquittals. Similar protesters were held in other cities, including the Mediterranean port city of Alexandria and Suez on the Red Sea.

"Justice was not served," said Ramadan Ahmed, whose son was killed on Jan. 28, the bloodiest day of last year's uprising. "This is a sham," he said outside the courthouse.

Protesters chanted: "A farce a farce, this trial is a farce" and "The people want execution of the murderer."

Mubarak, 84, and his ex-security chief Habib el-Adly were both convicted of complicity in the killings of some 900 protesters and received life sentences. Six top police commanders were acquitted of the same charge with chief Judge Ahmed Rifaat saying there was a lack of concrete evidence.

That absolved the only other representatives of Mubarak's hated security forces aside from el-Adly. It was a stark reminder that though the head has been removed, the body of the reviled security apparatus is largely untouched by genuine reform or purges since Mubarak was ousted 15 months ago.

Many of the senior security officials in charge during the uprising and the Mubarak regime continue to go to work every day at their old jobs.

In many ways, the old system remains in place and the clearest example of that is a key regime figure ? Mubarak's longtime friend and last prime minister Ahmed Shafiq ? is one of two candidates going to the presidential runoff set for June 16-17.

The generals who took over from Mubarak have not shown a will for vigorously prosecuting the old regime. That is something that neither Shafiq or his challenger Mohammed Morsi may have the political will or the muscle to change when one is elected president.

Shafiq last week declared himself an admirer of the uprising, calling it a "religious revolution" and pledged there would be no turning of the clock while he is at the helm. On Saturday, he said the verdict showed that no one was above the law in today's Egypt.

Morsi of the fundamentalist Muslim Brotherhood quickly tried to capitalize on the anger over the acquittals, vowing in a news conference that, if elected, he would retry Mubarak along with former regime officials suspected of involvement in killing protesters.

"Egypt and its revolutionary sons will continue their revolution. This revolution will not stop," he said.

The case against Mubarak, his sons, ex-security chief and six of his top aides was very limited in scope, focusing only on the uprising's first few days and two narrow corruption cases. It was never going to provide a full accountability of wrongdoing under Mubarak's three-decades of authoritarian rule enforced by a brutal police force and a coterie of businessmen linked to the regime who amassed wealth while nearly half of Egypt's estimated 85 millions lived in poverty.

Mubarak and his two sons were acquitted of corruption charges, along with family friend Hussein Salem, who is on the run. The corruption charges were related to the purchase by the Mubaraks of five villas built by Salem at a fraction of their price and Mubarak's decree to allow a Salem company to export natural gas to Israel. Rifaat cited a 10-year statute of limitations that had lapsed on the case of the villas.

The sons ? one-time heir apparent Gamal and wealthy businessman Alaa ? will not be freed because they are awaiting trial on charges of insider trading. They have been held in custody in Torah prison, the same jail where Mubarak was flown after the sentencing.

The charges related to killing protesters carried a possible death sentence that the judge chose not to impose, opting instead to send Mubarak to prison for the rest of his life.

After the sentencing, Mubarak suffered a "health crisis" on a helicopter flight to a Cairo prison hospital, according to security officials who spoke on condition of anonymity because they were not authorized to speak to the media. One state media report said it was a heart attack, but that could not immediately be confirmed.

The officials said Mubarak cried in protest and resisted leaving the helicopter that took him to a prison hospital for the first time since he was detained in April 2011. They said the former leader insisted he be flown to the military hospital on the outskirts of Cairo where he was held in a luxury suite during the trial. Mubarak finally left the chopper and moved to the prison hospital more than two hours after the helicopter landed there.

Earlier, Mubarak sat stone-faced and frowning in the courtroom's metal defendants' cage while the judge, Ahmed Rifaat, read out the conviction and sentence against him, showing no emotion with his eyes concealed by dark sunglasses. His sons Gamal and Alaa looked nervous but also did not react to either the conviction of their father or their own acquittals.

Rifaat opened the session with an indictment of Mubarak's regime that expressed deep sympathy for the uprising 15 months ago.

"The people released a collective sigh of relief after a nightmare that did not, as is customary, last for a night, but for almost 30 black, black, black years ? darkness that resembled a winter night," he said.

"They did not seek a luxurious life or to sit atop the world, but asked their politicians, rulers who sat on the throne of opulence, wealth and power to give them bread and clear water to satisfy their hunger and quench their thirst and to be in a home that shelters their families and the sons of the nation far from the rotten slums," he said.

"They were chanting 'peaceful, peaceful' with their mouths while their stomachs were empty and their strength was failing. ... They screamed ... 'rescue us and pull us from the torture of poverty and humiliation.'"

Rifaat criticized the prosecution's case, saying it lacked evidence and that there was nothing in what has been presented to the court that proved that the protesters were killed by the police. Because those who pulled the trigger have not been arrested, he added, he could not convict any of the top police officers of complicity in the killing of the protesters.

The question of who ordered the killings of protesters was left unanswered.

The prosecution had complained during the trial that it did not receive any help from the Interior Ministry in its preparation for the case and, in some cases, prosecutors were met with obstruction.

One of the uprising's key pro-democracy groups, April 6, rejected the acquittals, saying Rifaat at once paid homage to the protesters and ignored the grief of the families of those killed by acquitting the top police commanders.

"We will continue to cleanse Egypt from corruption," the group said.

Most of the several hundred who attended the court session represented all branches of Mubarak's police state ? police conscripts in plainclothes, uniformed policemen ranging from lieutenants in their early 20s to graying generals, and mysterious looking men in business suits with two-way-radios treated with reverence by their uniformed colleagues.

Outside the courtroom, a lecture hall in a police academy on the outskirts of Cairo that once bore Mubarak's name, there was jubilation initially when the conviction was announced. One man fell to his knees and prostrated himself in prayer on the pavement while others danced, pumped fists in the air and shot off fireworks.

But that scene soon descended into tensions and scuffles, as thousands of riot police in helmets and shields held the restive, mostly anti-Mubarak crowd back behind a cordon protecting the court.

Angered by the acquittals, lawyers for the victims' families broke out chanting inside the courtroom as soon as Rifaat finished reading the verdict.

"The people want to cleanse the judiciary," they chanted. Some raised banners that read: "God's verdict is execution," while others screamed "illegal!"

U.S.-based Human Rights Watch called the verdict a "landmark conviction" but criticized the prosecution for failing to fully investigate the case.

Maha Youssef, a legal expert from the Nadim Center in Cairo, said the judge's verdict should be the basis of a successful appeal to throw out the convictions.

"It's a completely politicized verdict that is meant to calm the masses. The essence of a ruling by a criminal court judge is not in the papers of the case but in his own personal conviction as someone who lives among the people and know what goes on in his society."

UNIVERSAL CITY, California — Mark Wahlberg has a message for the 2012 MTV Movie Awards host: Crack the wrong jokes, Russell Brand, and you'd better duck.

Speaking to MTV News backstage at the taping of Spike TV's "Guys Choice Awards" on Saturday night, the man whose real-life boxing skills were on display in "The Fighter" acknowledged that the English comedian has a reputation for being unpredictable.

"I hope he does a good job," Wahlberg cautioned. "I hope he doesn't say nothin' smart about me, because he's going to 'unpredictably' get his ass whooped."

Wahlberg wore a sly grin as he delivered his beat-down promise, detailing further what might happen should Brand say something too biting from the Gibson Amphitheatre stage tonight (June 3): "I would put the worst insult of all time on him, for sure. And it's an easy thing to do, given his look."

The tongue-in-cheek rant was delivered to MTV News' own Josh Horowitz, who has been comically menaced by Wahlberg on several occasions. The pair have continued their playful banter on red carpets and at events ever since that infamous episode of "The Knife Show," which went viral.

The 40-year-old actor/producer will be one of the presenters at the Movie Awards Sunday night, which will put him in close proximity to his possible target. "No, no, he's a funny guy," Wahlberg said, letting up for a second. Then the taunts resumed: "But, you know, listen: f--- around, lay around — you know me."

An obscenities-laden rant that bobbed and weaved in and out of an English accent followed.

"Listen, I love ya, baby, but this ain't the mother------ to be f---ing with. This ain't the U.K., baby. This is where you get the ole' smack," he said. After the last two Golden Globes awards shows, at least one other British comedian developed a certain reputation for "roast"-style performances while hosting. "I hope [Brand] is a proper U.K. comic like Ricky Gervais and Steve Coogan," Wahlberg said, still mining his convincing British accent.

Wahlberg, of course, was playing all of it for laughs, frequently cracking a smile, but he did issue a further warning to Brand: stay away from the cast of his upcoming movie, "Ted." Mila Kunis, Seth McFarlane, and for some reason, the star of "Mad Men" (who isn't in "Ted") are off limits.

"Listen, I'm telling you, if he f---s with me, I'm the wrong dude to f--- with. And don't f--- with my people, either! Don't say sh-- about Mila, don't say sh-- about Seth. And don't say sh-- about Jon Hamm. I don't know him, but, I'm putting him under my wing."

How to write a legally safe job-offer letter ? Business Management ...

When it comes to making job offers, you or your hiring managers could be inadvertently locking the organization into employment contracts with new hires. It?s a common mistake, and only a few misplaced words can sink you.

Employers that use written job-offer letters run the highest risk of creating implied promises.

If you want to retain the ability to fire at will, make sure any memos, letters or emails detailing a job offer don?t create an employment contract. That means never promising that termination will be for cause or for any list of reasons.

Recent case: When Aubrey Burkett was hired, his offer letter included his salary and commission terms. Both Burkett and the company president signed the letter, which was captioned ?Employment Contract.?

When Burkett was terminated, he sued, alleging the company breached the employment contract. He lost. The court said the letter didn?t specifically say the employer agreed only to terminate Burkett for cause. Without that, Burkett remained an at-will em??ployee.

But this employer created unrealistic expectations?and a lawsuit?that could have been avoided. Why call something an employment contract if that?s not what you intend? (Burkett v. Ulrich Barn Builders, No. 10-11-00392, Court of Appeals of Texas, 2012)

Advice: A better approach is to have your attorneys approve a standard offer letter. Make sure it includes a disclaimer that clarifies there is no employment contract and that the employee is being hired ?at will,? meaning your organization can terminate his or her employment at any time for any nondiscriminatory reason.

That way, there is no question about your intent and no need to get a court involved in interpreting what the letter means.

5 do?s and don?ts

To avoid creating any job-security promises, here are five more do?s and don?ts when offering a job:

1. Don?t imply job security with statements such as, ?You?ll be able to grow here? or ?You have a long career here.? Specify the job?s starting date, but keep out any reference to length of employment.
2. Don?t describe job responsibilities. Cite the name of the new hire?s boss and explain that they?ll meet on the first day to discuss duties.
3. Do clarify that continued employment depends on several things, including following organization policies and procedures. Cite job-offer contingencies, such as signing a nondisclosure agreement or drug test.
4. Don?t cite an annual salary figure. Courts could see that as a one-year hiring commitment. Instead, specify how much the employee will receive each pay period.
5. Don?t ask new hires to sign offer letters. But keep a copy in your files. If you make the offer orally, keep notes of what you promised.

Anxiety: We worry. A gallery of contributors count the ways.

I got a call from a friend last year. He had prostate cancer and wanted some help thinking through what to do. He had gone to his doctors for the details about his physical condition. He was calling me for help dealing with the other condition he knew he was facing ? excessive fear of this dreaded disease that sometimes does more harm than good, what some have called ?cancer phobia.? [1]

He knew that, like many cases, his prostate cancer had been detected when it was still asymptomatic, and was the slow-growing kind unlikely to ever become symptomatic or to kill him ? given he was an otherwise healthy man in his 50s ? before old age did. He also knew about the occasional side effects of treatment ? urinary incontinence, rectal bleeding, sexual impotence ?? risks that thousands of men take each year not so much to remove from their bodies something that might harm them, but to remove from their minds the fear of living with cancer.

Nonetheless, he said he was leaning toward treatment, and recognized that his emotions were making it hard to think rationally about the clinical medical evidence. I gently suggested that the perception of risk is so often based more on emotion than just the facts, and the roots of the fear of cancer are so broad and deep, that understanding these anxieties might not help much. But I offered what I could.

Physical risks, I told him, have psychological characteristics that make them feel scarier or less scary, regardless of actual probability or evidence. And cancer triggers a couple of the most powerful of these emotional alarms. Research by experts in the field of decision and risk, like Paul Slovic of the University of Oregon and Baruch Fischhoff of Carnegie Mellon, has found that the more pain and suffering a risk involves, the more fear it causes. Many forms of cancer involve a great deal of pain and suffering. We are also more afraid of risks we can?t control and, despite great medical progress, most people still feel they have little control over cancer ? either getting it or fighting it. Many people still assume that a diagnosis of cancer is a death sentence.

I also told my friend that cancer has been stigmatized. In the psychological sense this means that as soon as we hear the word, subconsciously all sorts of bad and frightening associations go off which frame how we think and how we feel ?about anything else we then learn. This aspect of cancer phobia is rooted in the perfect storm of conditions in the 1950s and 60s when cancer first fully blossomed into public consciousness. The atomic bombings of Japan, and the Cold War, seared into our psyche the tangible existential threat of nuclear annihilation, a deep dread that was closely linked with fear of radiation from the fallout from atmospheric nuclear weapons testing. The health consequence of radioactive fallout ? the reason to fear it ? was cancer.

Evidence first started reaching the public in the 1950s about the carcinogenicity of smoking. An issue of Reader?s Digest in 1950 featured an article titled ?Cancer by the Carton.? And as the modern environmental movement got going in the ?60s, it used the threat of cancer as a central rallying theme. Rachel Carson?s classic cri de coeur, ?Silent Spring,? featured a whole chapter on cancer, warning that we were ?living in a sea of carcinogens.? To drive home those fears, she regularly compared the danger of industrial chemicals to the risks of radiation.

Given how this confluence of events magnified the innately frightening nature of cancer, it was no wonder that when the National Cancer Act passed in 1971 the introduction declared? cancer to be ?the major health concern of Americans today.? It still is.

A recent Harris poll found that cancer is the most feared disease in the United States; 41 of those polled listed it at the top, with Alzheimer?s next, at 31 percent. The benefit of all this fear, of course, has been a body of laws and regulations, and changes in individual behavior, that have significantly reduced the risk of what is indeed a group of horrible diseases. It has given rise to medical progress that has made many once-fatal forms of cancer treatable, and in some cases even preventable. But the costs of cancer phobia have also been significant.

One example of the impact it has had at the policy level can be seen at the National Institutes of Health, which spends more than twice as much researching the molecular biology of cancer ($5.4 billion a year) than on figuring out the mechanisms of heart disease ($2 billion a year), which kills more people. [2] It?s a fair to suggest that more people might be alive or healthier if those investments were proportional to the risk.

The health damage from cancer phobia has been significant in many ways at the individual level, too, and not just with prostate cancer. In ?Overdiagnosis in Cancer? doctors at Dartmouth classified 25 percent of breast cancers detected by mammography, 50 percent of lung cancers detected by chest x-ray or sputum tests, and 60 percent of prostate cancers detected by the prostate specific antigen (PSA) test, as ?overdiagnosed.? The authors describe how these overdiagnoses often lead to medically unnecessary treatments, sometimes involving radical surgery, that have major impacts on the patients? quality of life.

The authors of that study are careful not to ascribe this to fear. But a panel of experts on prostate cancer convened by the National Institutes of Health was pretty clear that our dread of cancer contributes significantly to the harm that it does. So much so that for slow growing prostate cancer they recommended: ?Because of the very favorable prognosis of low-risk prostate cancer, strong consideration should be given to removing the anxiety-provoking term ?cancer? for this condition.?[3]

I didn?t get into all those details with my friend. But I did tell him that the fear of cancer can contribute to chronic stress, which raises blood pressure and increases the risk of cardiovascular disease, and which weakens the immune system and increases the likelihood of all sorts of health problems. (A weakened immune system increases the likelihood of getting cancer in the first place, and makes it harder to fight off once you get it[4]). So unless he could deal with the fear of living with cancer, cancer phobia alone might make him sick.

My friend was in a tough place. Cancer, in many of its forms, is a terrible disease. I?ve had it. I?ve lost relatives and friends to it. But cancer is also a frightening disease, and that fear, and the harms it can do, are no less real than the disease itself. Cancer phobia is powerfully rooted in the deep instinctive ways we perceive and respond to risk, and like many forms of cancer itself, hard to overcome.? My friend thanked me, and said that just knowing all that gave him a reassuring sense of control and helped him put things in perspective as he faced his difficult choice.

A year after our conversation my friend and his wife treated me to dinner at a fine restaurant. He?d decided to have radiation treatment to eliminate the cancerous cells, and was at peace with his decision, even though the treatment left him with at least one permanent side effect. He had to go to the rest room three times over two hours to urinate, something this 50-ish year-old man will have to deal with for the rest of his life ? a price he was willing to pay not so much to cure a physical disease, but to cure the powerful fear he just couldn?t face.
